A survivor of historical sexual abuse has been awarded six-figure damages after being represented by Winston Solicitors.
Our client, now in his 50s, suffered sexual and physical abuse at the hands of his older brother back in the '70s. He brought a claim for Criminal Injuries compensation after reporting his abuser 35 years later. His resulting payout was over £165,000.
CICA Under Scrutiny on Historical Abuse Cases
The Criminal Injuries Compensation Scheme was scrutinised for many years for not recognising that many children, and adults were victims of abuse in their own homes. Far too often, there is a misconception that sexual abuse is usually carried out by a “stranger.”
Historically, a rule, known as the “Same Roof Rule” under the scheme, prevented victims, who lived with their abuser at the time the abuse took place, to make a claim. However, in 2019, this rule was finally (and quite rightly) abolished, opening the scheme to many historical abuse victims who previously would not have been eligible for compensation.
The victim, who wishes to remain anonymous, was advised by the police to make a claim through the CICA for compensation, which he did. However, he found the process with the CICA to be difficult to navigate and, as such, sought the expertise of Winston Solicitors to take over his claim shortly after applying.
